Terms of Service
Effective July 3, 2026
1. The service
DumpsterOS is business-management software for waste-hauling and junk-removal companies, provided by FlockSoft LLC ("we"). Your company ("you") gets an account, your team gets seats per your plan, and your customers may interact with your branded booking and portal pages.
2. Your account
You're responsible for what happens under your account and for keeping credentials safe. Seats are for your personnel; driver seats are free and unlimited for your active drivers.
3. Subscriptions & billing
Plans bill monthly in advance at the published price and cancel anytime, effective at the end of the paid period. Add-ons prorate. Nonpayment may suspend access after notice; your data is retained during suspension.
4. Your data is yours
Everything you and your customers enter — jobs, customers, photos, billing history — belongs to you. Export it anytime in CSV and QuickBooks formats. If you leave, we'll retain your data 90 days for retrieval, then delete it.
5. Our responsibilities
We run the service with commercially reasonable skill: daily backups, encryption in transit, tenant isolation. We target high availability but don't warrant uninterrupted service; scheduled maintenance is announced.
6. Acceptable use
Don't use the service to break the law, send spam through messaging features, probe other tenants' data, or resell access. Message sending must comply with applicable telemarketing/consent rules for your recipients.
7. Payments processing
Card processing is provided by our payments partner under their terms; we never store full card numbers. Processing fees are disclosed at activation.
8. Liability
To the maximum extent permitted by law, our total liability for any claim is limited to the fees you paid us in the twelve months before the event. We're not liable for indirect or consequential damages, including lost profits or lost business data caused by factors outside our control.
9. Changes
We may update these terms with 30 days' notice for material changes; continued use is acceptance. We won't retroactively degrade what a published plan includes.
